Guatemala Investigators

Private Investigator in Guatemala

Privin Network provides private investigation services in Guatemala, connecting clients with investigators and local partners experienced in background checks, surveillance, infidelity investigations, corporate due diligence, and international cases. Private investigation is a licensed activity in Guatemala, authorized under the Law Regulating Private Security Services (Decree 52-2010) and the General Directorate of Private Security Services (DIGESSP).

Our investigators and local partners work throughout Guatemala, including in Guatemala City, Mixco, and Villa Nueva. Guatemala City, the capital, is home to Zona Viva, the country’s financial and commercial hub, making it a frequent setting for corporate due diligence. Mixco, Guatemala’s second-largest city, has shifted from an agricultural economy toward commerce and services, generating personal and employment-related cases. Villa Nueva, home to roughly 100 factories and the country’s largest wholesale market, is a center for employment and corporate-fraud investigations tied to its manufacturing base. Wherever your case is based, our investigators and local partners know the area.

Local Guatemala Private Investigator

Our success is based on your success, and here are some of the many professional services our local Guatemala private investigator(s) can provide:

Personal Investigations
Not everyone is always who they say they are. Whether it’s an individual or a corporation, determine who they are and why they’re there.

Surveillance
An organization or individual may find that they need surveillance help due to suspicious behavior or due to a situation or event that may have occurred.

International Investigations
If you have a business relationship or are contemplating a new business venture in a particular country, it’s not uncommon to need the services of a private investigator to verify good information about an individual or corporation.

Locate Investigations
With our investigative skills, including skip tracing and searches of the General Property Registry and Commercial Registry, we can help you locate individuals, assets, or property that have been intentionally concealed.

Cybercrimes and Digital Forensics
Equipped with the right technology and a highly skilled staff of professional investigative specialists, we can assist you in identifying a suspect, the purpose of an attack, and how it occurred. Guatemala’s existing cybercrime provisions, Penal Code Articles 274-A through 274-G, are narrower and older than those of many countries; a more comprehensive Cybersecurity Law has been under congressional review since 2024 but has not yet been enacted.

Infidelity and Adultery Marital Investigations
A marriage or relationship brings with it the expectations of monogamy, but many find themselves in situations where this expectation is not being met by one or both of the individuals involved.

Divorce, Custody, and Background Check Service in Guatemala

Guatemala’s Law on Access to Public Information (Decree 57-2008) guarantees access to public government records, including civil litigation history, property registry deeds through the Registro General de la Propiedad, and commercial registry filings through the Registro Mercantil. Private bank accounts and tax records remain protected by Guatemala’s banking secrecy laws (Secreto Bancario) and cannot be accessed without the account holder’s consent.

Guatemala’s Civil Code (Decree-Law 106, 1963), Article 155, sets out a fault-based system for divorce, with adultery, cruel treatment, abandonment, and a period of de facto separation all recognized as grounds; an innocent spouse generally must file within six months of learning of the act. Divorce by mutual consent is also available once a couple has been married for at least one year. Custody is decided separately by the court, which may consider social-work reports when parents cannot agree.

Legal Framework for Private Investigations in Guatemala

Private investigation is a licensed activity in Guatemala under the Law Regulating Private Security Services (Decree 52-2010), which created the General Directorate of Private Security Services (DIGESSP) to authorize, supervise, and monitor private security and investigation companies. It’s important to hire an agency that complies with these regulations, since evidence collected by an unlicensed investigator can be challenged in court.

Guatemala has no comprehensive data protection law in force; a dedicated Data Protection Law has been pending in Congress since 2022 and has not yet been enacted. In its absence, data-privacy protections come from narrower sources, including a right to informational self-determination recognized by Guatemala’s Constitutional Court.

Under Article 24 of the Political Constitution of the Republic of Guatemala, the secrecy of correspondence and telephone communications is inviolable. Intercepting or recording private communications without a specific judicial order, available only to the Public Ministry in criminal cases, is a felony, and evidence obtained this way is inadmissible in court.

Frequently Asked Questions

What types of clients does Privin serve in Guatemala?

Clients include individuals, law firms, small businesses, large corporations, insurance companies, and non-governmental agencies.

Is confidentiality guaranteed during an investigation?

Yes. Our investigators and local partners emphasize discretion, confidentiality, and ethical conduct in every assignment.

Is private investigation legal in Guatemala?

Yes, but it is strictly regulated. Investigation agencies in Guatemala generally operate under the Law Regulating Private Security Services (Decree 52-2010), which requires licensing by DIGESSP. Hiring a licensed agency helps ensure that any evidence collected is admissible in court.

Can a private investigator in Guatemala tap phones or record calls?

No. Under Article 24 of the Political Constitution of the Republic of Guatemala, the secrecy of correspondence and telephone communications is inviolable. Intercepting private communications without a specific judicial order is a felony, and any evidence obtained this way is inadmissible in court.

Is Guatemala a member of the Hague Service Convention?

No. Guatemala is not a signatory, so formal legal documents are generally served through Letters Rogatory via diplomatic channels, a process that can take 6 to 12 months. Our investigators and local partners can also arrange private process service as a faster, informal alternative in many cases.

What access do investigators have to criminal and financial records?

Guatemala’s Law on Access to Public Information (Decree 57-2008) grants access to public records such as property registry deeds and commercial filings, but private bank accounts and tax records remain protected by Guatemala’s banking secrecy laws and cannot be accessed without the account holder’s consent.

Is personal data protected by a privacy law in Guatemala?

Not comprehensively. Guatemala has no dedicated data protection law in force, and a bill has been pending in Congress since 2022. In its absence, data-privacy protections come from narrower sources, including a constitutionally recognized right to informational self-determination.

Does adultery affect divorce or custody in Guatemala?

Adultery is one of several recognized grounds for divorce under Guatemala’s Civil Code, but a case based on it generally must be filed within six months of discovery. Custody is decided separately by the court, which may rely on social-work reports when parents cannot agree.

Can investigators locate hidden assets in Guatemala?

Yes. Our investigators and local partners search the General Property Registry for real estate holdings, the Commercial Registry for corporate shareholdings and directorships, and vehicle registration databases to build a lawful financial profile of a subject.

What cybercrime laws apply to digital investigations in Guatemala?

Guatemala’s existing cybercrime provisions, Penal Code Articles 274-A through 274-G, are narrower and older than those of many countries. A more comprehensive Cybersecurity Law has been under congressional review since 2024 but has not yet been enacted.
