El Salvador actually has two separate government-issued good-conduct documents, and it’s worth knowing which is which: the solvencia de antecedentes penales, a criminal-record clearance issued by the Dirección General de Centros Penales, and the solvencia policial, a police clearance issued by the Policía Nacional Civil. Both cost a nominal fee and certify that a person has no convictions or pending charges, but they come from different agencies and aren’t interchangeable.
Private investigation is a named, licensed category of its own in El Salvador, not just an informal activity, under the Ley de Servicios Privados de Seguridad (Legislative Decree No. 227). The law recognizes private investigation agencies as a distinct category from security guarding, requires a Policía Nacional Civil operating authorization renewable every three years, and requires each individual investigator to be personally authorized by the PNC. The same law explicitly bars private investigation agencies from violating personal privacy, intercepting communications, or compromising anyone’s physical or moral integrity.
El Salvador’s data privacy framework is brand new: the Ley para la Protección de Datos Personales (Legislative Decree No. 144) took effect on November 23, 2024, after an earlier version was vetoed in 2021. It applies to both public and private organizations and requires covered organizations to appoint a dedicated data protection officer.
El Salvador follows a one-party consent standard for recordings. Under Article 186 of the Penal Code, intercepting or recording a communication is only a crime when the person doing it was not a participant in that communication; a participant may record their own conversation without the other party’s consent. A separate law, the Ley Especial Contra los Delitos Informáticos, makes it a crime to disseminate a private recording without the consent of the person it concerns, carrying three to five years in prison, rising to four to eight years for aggravating circumstances.
Salvadoran divorce law does not list infidelity as a direct ground for divorce. Under Article 106 of the Código de Familia, divorce can only be granted for mutual consent, at least one consecutive year of separation, or what the law calls an intolerable life between the spouses, and infidelity is commonly raised as evidence supporting that third ground rather than as a freestanding cause on its own.
El Salvador’s cybercrime law, the Ley Especial Contra los Delitos Informáticos y Conexos (Legislative Decree No. 260, in force since 2016), covers identity theft, unauthorized interception of transmissions, unlawful acquisition or disclosure of access credentials, and the misuse of personal or sensitive data, giving victims of digital fraud and privacy intrusions in El Salvador a real legal basis for building a case.
